thanks joker were you still signed off when this happened. can the so called medical overrule an exsisting fit note. my company would not allow me back on the say so of altos.

The £65/week is the assessment rate for ESA, so whether they have told you or not, you are in the process of making a claim.

The ESA50 form is the next step in that process, you will need to complete it and return it as directed.

The next step will be you attending a WCA medical at an ATOS Health centre.

You should read the Understanding ESA document and then the ESA Claims on Physical Grounds and if relevant ESA Claims on Mental Grounds. All of these are in the ESA Claims and Appeals section of the Members area.

yes, I was still signed off by my GP when the Atos "medical practitioner" awarded me nil points..Your GP can continue to sign you off but it just means that youe ineligible for ESA. At this point you may want to appeal the decision.

Sorry to butt in, but if you have been found fit for the work by ATOS, then your doctor will be written to by the DWP and told not to issue any further Fit notes for that condition. Unless you can show your condition has significantly worsened or you have developed a new condition that would prevent you working, your options are

- You claim JSA, but you are required to look for work.

- You can appeal the decision and be put back onto ESA assessment rate. Your doctor will then need to issue Fit notes until your appeal is heard.

- You can become economically inactive.

with the help of my local advice place, I immmediately appealed the decision and went back on to the assessment rate.Because of the backlog, this has still to be heard. Snow scuppered the last hearing on Monday.Due to lack of money, I did go back to work (5 weeks of accumulated annual leave and 3 weeks of a phased return)before my GP made me go off again.This gave me enough N.I. contributions to qualify again for SSP. This unfortunately ended when I was made redundant at end of Oct. Cue to start the process of claiming ESA again. so I'm in the situation of claiming again while still waiting to have my appeal tribunal heard

I'm glad the mystery as to what SCP was was cleared up. I originally read it as SSP, but then realised it read SCP and didn't know what it was.
