Hi I am new to the forum and this is my first post. I have received an ESA50 form and I am confused as to why. My situation is that I have been off work for about 16 months and after 12 months my company's insurance company requested information from my doctor etc and then said that they would review me again in 12 months. They pay me 69% of my salary less SCP if I claim it or not. as I am not employed, how does the ESA apply to me. Thanks for any help you can give.

It is possible to get ESA whilst still employed by someone provided that you are unfit for work and not in receipt of Statutory Sick Pay.

If you have paid sufficient NI contributions, ESA will not be means-tested and therefore if you are paid part of your salary, this will not affect your ESA.

thanks for the quick reply, i made some mistakes in my post ie i am employed not un employed. as i am employed and the dwp pay me scp how does the esa form apply to me. sorry but i have never been in the system before and feel confused.

You don't have to be unemployed to claim ESA, but I hadn't picked up on the SCP point - hopefully one of my fellow moderators will be able to help you.

sorry surviver i may be confusing you it used to be called scp but is that the same as esa. i submit a sick note every three months to the dwp and my employer so how does the esa form apply to me as i thought it was for those who were unemployed and claiming benefits. how will they place me into a catergory.
