IB & DLA stopped after ATOS Medical

Hi All

IB and DLA stopped after ATOS Medical from 16th Nov. Decission maker decided I was fit to work,based on the information fron ATOS.
CFS awarded 0 points
Mental Health awared 3 points
The ATOS Nurse who examined me definatly didn't listen to the answers I gave and most of the time was looking at her computor screen and seemed disinterested,
The decission letter definatly belong to someone else as the were not based on the answeres I gave.
The Job Centre staff couldn't give me a form for ESA as they didn't have any and were waiting for a delivery so I would have to phone the number they gave me and make my new claim that way.
After taking ages to get through on the phone this guy guy starts taking my details then asks if I would be appealing the decission when I said yes he said he couldn't continue with the claim and would send a form out which sould arrive in 7 to 10working days and if I needed mony I could apply for a Crisis Loan that I could use to buy food. The amount of Crisis Loan awared probably wouldnt be very muchand I could only make a claim for 2 loans as they had tobe paid back for your benifits.
So I can't pay may bills or pay for prescribed medecine.
My friend got the ESA from the same Job Centre for me when I was still on the phone.
I am so glad that I found this site and am already using the info to fill in the ESA form. will keep you posted on how things go.

Hi Kriss,

If your IB was stopped then, providing you don't have too much income or capital, you should be able to claim income support at a reduced rate whilst your appeal is pending, rather than ESA.

It's certainly worth considering as it would not involve another medical assessment.

It breaks my heart to hear your story Kriss.
I know the pain you must feel,and there are many who fear what you are going through. I can only say that you must appeal now and make sure you get everyone on your case that you can.Make your GP first stop and any medical people you are going to .Losing both of these at same time is disgraceful if you are ill or infirm,and only backs up the heartbreaking words I see and hear on this site every day. The inhumanity towards welfare users is a downfall of heart in the UK.

This is the 3rd time since Octoer 2005 that I have been through this, doesn't seem to matter what you say at your medical, it seems irrelevant depending on the medical person who examins you, if they are going to over-ride the system (and there might be 1 or 2)and be truthful.
I had the same medical Feb 09, taken off IB, appealed against decission, put on Income support,won my appeal in July 09,back on IB +back dated award.
This time system is completley different, was informed that ESA has replaced IS and IB so even if I insisted on being put on IS that wasn't going to happen.
So here I go again (is that no the title of a song ??) already contacted the appeals people and am sending relevant paper work to them, then wait for the appeal date.
I have also spoken to my MP and took the paperwork sent by DWP to show him, the scary thing was he said that most of the paperwork he had read seemed to say the same thing FIT FOR WORK, He did say that he will be raising this issue again at Parliament.

Will apply for ESA and save my strength for the appeal, sometimes find it pointless argueing with staff at the Job Center as they are only doing their job,otherwise its detention for them.
As always I will try to see the funny side of things and stay positive as too much negativity pulls me down and doesn't help my conditions.
