I just wanted to add another point to my previous comment regarding "working on your back". Having thought about this most of the evening, and I know that I am stating the obvious; I believe that the "doctor" has incorrectly applied the test in relation to your back.

The test in question relates either to your ability to stand or your ability to sit, not your ability to lie horizontally. As such the conclusion that you should no points for this test is incorrect and should be challenged.

A point for both your Tribunal and if you decide to make one, your complaint.

Hi folks,

Please do remember that any complaint about the actions or inaction of the medical/Atos/etc will be dealt seperately from the due process of claiming the benefit.

Thus process for claiming the benefit gives the claimant the right in law to have her case heard before an independent panel at a 1st Tier tribunal and upwards from there based on any points of law.

There is a seperate process for complaining about ATOS/DWP etc which will be dealt with as a seperate matter to the tribunal.
