I have been asked by the DWP to complete yet another IB50 form. No doubt I will be hauled in yet again for another medical so I want to get prepared. Could someone please tell me if there is a legal requirement for ATOS to provide a healthcare professional that has training and or experience in relation to my particular disabilities. I have a mixture of mental health and physical disabilities and on my last medical the ATOS person that did the medical had no clue about my disabilities. Due to this I failed the medical, had to go to appeal, but got my IB reinstated at appeal. It was a right ordeal though and really cant face going through it again
There doesn't appear to be any obligation on Atos to provide a specialist in whatever a claimant has to assess them, annoying though that can be if you have a condition they know very little about.
Thanks for the prompt reply! I thought that there was something in the contract between ATOS and the DWP that they had to provide a HCP that was at least knowledgeable about the medical conditions they are assessing.
