Carer's allowance was created by Melanie Tudor
I was recently awarded the higher rate for care, and the lower rate for mobility of my DLA. My husband recently became unemployed. Can he claim for carer's allowance? thanks

If he is claiming an overlapping benefit, such as Contribution-based Job Seekers Allowance, then he falls in the trap of overlapping benefits so could not claim Carers Allowance for you.

He gave up work as a teacher because he could not work in such a stressful and demanding job and look after me at the same time. Over last few years he has worked for a care agency as a care assistant so that he could work his shifts around me. This week the disabled man he cared for died which means that he has no work. This has happened at the time that my illness has worsened and only recently have I been in receipt of benefits. The fact that I am on a higher rate for care and the fact that he does have to care for me surely means that he has the right to apply for carer's allowance?

Yes, your husband can claim Carers Allowance but if he receives other certain social security benefits which Jim has alluded to in his post, the amount of any benefit your husband receives may be reduced or terminated altogether.
