I had my Employment and Support Appeal today and I am very very pleased to say I was awarded 18 points after previously only being awarded 6.
It's such a relief. It has been a very stressful 9 months researching decisions and gathering evidence. My life has been in limbo and I have suffered many a migraine with the stress of it all. I did have the support of Citzen's Advice but he admitted I had done all the work myself and it is only by virtue of the fact of joining this site and using the guides that I was able to be so thorough. I did think I would be awarded 9 points for not being able to bend down instead of the 6 they have given me but I'm pleased nonetheless. Don't know what it means yet for the future, especially in this current climate of benefit cuts. At least I know the system better now and will feel in a stronger position to appeal again, should I get called in at sometime for another medical and fail. I may re-apply for Disablity which they turn me down for using my Employment and Support Allowance Medical as one of reasons for not awarding it to me. So one and all take heart and state your case. Thankyou Benefit and Works I feel like I've won the lotto

Well done Louise --I also was turned down for DLA after they said i failed my ESA medical with 9 points. Do you, or anybody, know whether the new points are added to your ATOS records so that DLA people can see them.

I'm not absolutely certain but I think it would be unlikely. The DWP will only be given the Decision Notice (which doesn't have much detail).
It is vital when appealing to point out to the tribunal if the DWP rely on medical evidence that was subsequently overturned on appeal.

Congratulations on winning your appeal.
As Derek says, there will be a record on your files of your having won your appeal but that will be about it.
Bit late now, but it's always worth appealing a DLA refusal if it's based on an IB or ESA medical that you are appealing. Though I know that for many people the thought of having two appeals on the go at once is beyond endurance.
