i dont know if anyone can advise me but in june 2010 i went to an tribunal, the out come was a desision notice saying i had won and had low rate care and motabillity componant wich was fantastic after 18 months or so of trying anyway 3 weeks later i recived a letter saying i could not be paid dla beceause thay wanted a ststement of reasons from the tribunal and i could not appeal against this. i have now been waiting another 3 months and cant get any help or advice from anyone. if anyone has any experience in this matter i would love to hear how thay got on, thanks.

Hi Andy
Following a First-Tier Tribunal both parties (you and the DWP) have the right to apply for a statement of reasons and appeal to the Upper Tribunal.
If the DWP have applied for a statement of reasons it does suggest that they are considering appealing against the decision to the UT, though it is not certain that they will do this. Tribunals Service should automatically send you a copy of the SOR at the same time as the DWP, if you have not already received it.
I'm sorry to hear that you have been unable to find an advisor, as this may be essential if the appeal goes further. Have you tried all the organizations listed in the guides?

That's a really rotten thing to happen.
One of the problems with the system is that judges aren't paid any extra for writing up their statement of reasons, they have to do it in their own time and often take ages to do so.
But if it's been three months now and you ahven't even been sent a copy of the statement you could try contacting the regional tribunal office and pointing out how unfair it is to keep you waiting this long and asking if they can hurry things along.

Thanks for the advice, ive rung them but its like banging your head against a brick wall, always the same reply youll just have to wait until you get a letter. anyway thanks again Andy.
