Identical (almost) DLA Claims

The two claim forms were almost identical due to them both having the same illness, same care/mobility and same medication and side effects.
Almost identical doctors letters were included with the claims, along with identical hospital details, care plans and prognosis details etc.
Both claims were sent off the same day.
One came back with an indefinate award for HRM and HRC without question within 4 weeks.
The other came back with a complete refusal after 12 weeks.
This illustrates the sheer inconsistancy with the DM's decisions. I cannot comprehend how the second one was refused as the letter attached with the refusal totally contradicts the medical evidence that was enclosed.
(He has completed the GL24 and it has already been sent for the refused claim)
I would appreciate your comments and thoughts and advice please - Grrrrr.

Your relative has done the right thing in appealing the adverse DLA decision, so other than lodging an appeal there is not much more can be done at this stage, other than to await the appeal submission of the DLA Unit from the Tribunals Service.

When we hear back from the appeals service we will probably submit another claim if reconsideration hasnt worked and see which is resolved the quickest.
