esa appeal was created by catherine
hello, I am appealing for esa as I scored 0 points in the medical, i have already lodged an appeal and have had my papers back. I believe that the doctor has misinterpreted what, I said, and could do, therefore I am challenging the doctors report.
I am told to expect appeal in july so can I still send evidence i have only just aquired to be added to my appeal papers to support my case. I would be grateful if anyone could help. :unsure:

Hi Catherine,

Tribunal rules were changed in 2008 so that any additional evidence should be submitted within one month of the date on which the appeal papers were sent out. You should send in any evidence you can within the deadline. However, it is often not possible to obtain evidence within this timescale and the tribunal judge has the power to accept late evidence.

Hi Steve thanks for your reply it helped.
I have sent 2 letters today to tribunal office requesting them to add these to my papers I was wondering if any one has done this before and been sucsessful :huh: Also can anyone tell me when does the judge look at the papers is it before you go to appeal or on the day please.

Hi catherine,

You should receive copies of the papers you have sent back from the Tribunals Service with handwritten numbers on them to add to your bundle.

The tribunal members are supposed to read the papers before the day of the hearing.
