Hi,

my hubby has had a brill idea, seeing as the DLA say I don't need any help during the night, even though I am hooked up to an IV overnight and look like Darth Vader, attached to another machine because of my sleep apnea, he says we should take a photograph of me, and send that as further evidence, what do you think :woohoo:

Hi,

To answer your first post first.

Yes, you can send in further evidence with your appeal form, or you can intimate on the form, that you will supply further evidence shortly.

There is no need to wait until your bundle arrives, as the DWP will first carry out a 'reconsideration' which your further evidence sent with the appeal form, or very shortly after, could help with.

Re your second posting re a photo, if you think that it would be helpful to your case, then by all means. Just make sure, as with anything else you send, it is appended with your name and National Insurance number.

I don't understand how they come to the decisions they do or what their reasoning is.

I was fortunate to have my DLA renewed at the same rate, but for the wrong reasons! :laugh:

They discounted the fact I can't cook myself a hot meal because of pain and dizziness and without endangering myself - I forget things and leave the cooker or grill on and wander off to do something else. I eat microwavable snacks, sandwiches etc....which they had accepted before.....

but this time they said I COULD cook myself a hot meal but that I needed help with communication, which they hadn't thought I needed before......! :unsure:

My condition hasn't changed at all except for being on more medication, but according to them it must have done. :huh: I'm just very lucky that although their reasons are wrong they have awarded me the same DLA as before. :dry:


It just makes no sense and I feel so sorry for people who lose out on their DLA because of the DWP's reasoning..or lack thereof.......! :(

Sadly the illogic of the DWP is not new or unique in your case. I was on HLC and HLM until my recent renewal. I submitted a very detailed form and they sent out a numpty doctor who spent a rushed half hour putting words into my mouth and completely ignoring what I said. The result was that although I got HLM for an indefinite period I got nothing at all for care!

Their reasoning was that I have now turned 65 and "had not shown prior to reaching that age that I needed sufficient care for the lower level!"

Duh!

I am seeing a welfare rights specialist next week and in the meantime have written today for a statement of reasons and a copy of the EMP report. I sent the letter recorded so the DWP cant say they didnt recieve it. They had initially sent my renewal forms to my previous address. I have only lined at this one for 7 years.

What a bunch of jobsworths.

I have now been in touch with the welfare rights lady, who has told me that she will not be able to represent me, as she is inundated with appeals, she has 15 next week, poor soul.

She has told me however that once I get my appeal date and bundle, that she will write a submission for me, which I hope will help, never been to an appeal before :( although she has said that she cannot go with me, at this time, she may be able to help more nearer the date.

Anyway, aboout the photo we where on about taking, I must say I look a pretty picture, hooked up to my machines, just wish you could see one :blush:

Hi i have just been turned down after 9 years of dla
My renewal form came it was the new shorter form the new forms are a con they say one thing and mean another
