PIP tribunal / worsening condition query

Hi,
I applied for PIP over a year ago and am waiting for my tribunal date. Since I have been waiting (over 6 months!), my condition has got worse. Should I contact DWP to tell them my condition has got worse or wait until the tribunal and tell the judge then?

Hi Mitch

I know you are already at appeal - but you can put in a change of circumstances to the DWP and tell them about your worsening condition (if you think this will make a difference to what you may be awarded). They will probably try and review your case - and should you win - it will be backdated to the point of which you put in for the change of circumstances. You can still leave your appeal open.

There is no point in waiting to tell the judge about your worsening condition - because the panel will be unable to take that into account. Their role is to judge whether the original decision at the time it was taken by the DWP was fair or not. They cannot take account of anything that happens after that date.
