My daughter is a university student. She had Carers Allowance in pay from 2020 until September 2024. She can not get Carers in Education so I applied for ESA with fit note listing her many disabities. She is also on PIP. She was refused twice the reason was she had not worked the relevant tax years. I pointed out she had Carer credits which entitle her. They now say she does not qualify as she is a student. I think they are wrong. She was getting Universal credit with carers and disability element from 2020 as I I submitted sick claim and filled in ESA 50 form. She was then exempted from work and no futher sick notes required. I think there was a rule that stated if you had a claim to sickness before university you could get ESA even though studying. can someone advise as DWP are useless assessing entitlement

Hi lorrainevb,

I expect you are being " palmed off " by a telephony agent who does not want to get into trouble by becoming involved in a timing consuming issue. Follow the advice here --

Staff at the DWP sometimes tell parents that they
don’t understand what a ‘credits only’ claim for new
style ESA is, or try to persuade families not to lodge a
claim because it has no chance of success. We would
recommend that when you lodge your credits only
claim you make clear that you understand that your
child will not qualify for new-style ESA itself, but are
completing the claim pack in order to establish their
right to national insurance credits on the basis of limited
capability for work under Regulation 8B of the Social
Security (Credits) Regulations 1975.
If the DWP refuse to accept or act upon a credits only
claim for new-style ESA call the Contact Helpline on
0808 808 3555 for help in challenging that decision.
