Hi, if I get my PIP award taken away do they stop paying you whilst the do the MR review. Also if it goes to court is your payment stopped until after the case is heard. THANK YOU

Hi JLP,

If you've been awarded under the points required by the assessor, then it is stopped until the MR or stages after as this happened to me, however if awarded in your favour, it is then backdated.

Chris.

Hi JLP

If you received a decision letter saying you were no longer eligible for PIP - the date when payments would be stopped would be on the letter. This would happen very quickly. (I can't tell you exactly as it varies depending on the date of your payments). If you disagreed with the decision and you put in for a Mandatory Reconsideration you would still not receive any money until and if that decision was overturned. If your award were restored, it would be backdated to the point where your money was stopped.

If you did not win the Mandatory Reconsideration and you had to go to Appeal - you would not receive any money during that process. (It can take up to a year). If you were to win the Appeal - your money would be backdated to the point at which it was stopped.

If you have any further questions - come back and ask.
