I’ve received a migration notice to move from IR ESA to UC. My child is being assessed for ADHD soon and I was going to apply for DLA once we have the diagnosis report. If I applied now instead, before applying for UC would the disabled child element be backdated once DLA was approved, meaning it wouldn’t come off my transitional protection? Or would it make no difference when I apply?
Transitional protection is the difference between the total amount of your Legacy Benefits ( the ones named in the Migration letter ) and your new UC monthly amount. If you think your situation is complex then get help from a local Benefits Advice agency as most are NAWRA members and can access the NAWRA Transitional Protection calculator. As far as the disabled child element is concerned the monthly amounts for UC are £156.11 for the lower rate and £487.58 for the higher rate. The general advice is to make sure you have claimed everything you can before Migration. However with UC there is a disabled child element so you should be able to work out the difference between what you get now and the UC figure I have given above.
