Hi, I have won an employment tribunal case against a former employerfor disability discrimination and am claiming new-style ESA.
I am in the support group.
Does anyone know how these things interact?
In particular - I am getting an award for past loss of earnings due to discrimination - does this affect my ESA? - Does the employer have to pay back the ESA I received? - How is this taxed?
Hi autistic-gremlin, In my experience your award for disability discrimination doesn't have an affect on your New Style ESA payments. As for an employer's obligations to repay ESA that is new to me. I have heard of contracts of employment that stipulate an employee who receives full pay for 6 months and then half pay for 6 months must repay any ESA they receive to the employer. But you would need to contact an Employment lawyer about the legitimacy of that. As far as taxation is concerned I have very little knowledge. Hope this helps, David
