Hi
I'm supporting a man with a Learning Disability who's being bullied at work and wants to hand in his notice. He's presently on working tax credits with his f/t job.
Will him leaving work voluntarily affect his ability to claim UC? -Will there be a mandatory gap in benefits as a result? (I have a distant memory that income support used to be refused fpr 3 or 6 mnths following voluntarily leaving work). I can make a good case for him having to leave, and I expect he should be eligible for LCW when on UC.
I've tried and failed to get in touch with a jobcentre for this info. Any advice would be most appreciated.

Hi Gary Fawcett,
First thing is if the above is your real name, it's best if you change your user name so that any confidential information cannot be traced back to yourself. You can choose anything as a user name but best to avoid anything personal.
If your friend leaves work and claims UC he will be asked by the Work Coach to complete a Leaving Voluntarily form ( unless he has LCWRA status ). However if he has " good cause " for leaving his job he won't receive a sanction. The bad news is that the Work Coach sends part of the form to the previous employer for their version of events. So it is important to have some corroborative evidence about the bullying to provide the UC DM ( Decision Maker ).
I think a good strategy would be to email the employer stating the reason he is leaving the job and copy the email to This email address is being protected from spambots. You need JavaScript enabled to view it. and then print out a copy of the email.
The National Bullying Helpline is a charity and its name is self explanatory.
