Hi,

My Brother-in-law is in the final stages of Alzheimer’s and is due to enter into a Nursing Home on Monday, 16th September.

He presently receives the Enhanced components of PIP.

I am wanting to establish his future entitlement when he is resident in the Nursing Home. He is Self-funding in the Nursing Home but has been awarded Funded Nursing Care (FNC) at £235 a week by the NHS.

Are you able to enlighten me?

It is not something that I have any knowledge of. I have just checked my bible 'Disability Rights Handbook" Edition 49 page 233

It states the following under PIP daily living component ' This has led to decisions that the daily living component is not payable where FNC is being paid to the nursing home for nursing care needs, even in the case of self-funders/retrospective self funders.
WRA 2012, S.86(2)&(3); PIP Regs, reg29(2)

It is quite a complex area and we would advise you to seek help from a Welfare Rights specialist Organisation; advicelocal.uk .
