DWP Re-inbursements affecting Bank account limit of £6,000

Hi everyone,

I was wondering if anyone has had this issue given the frequent delays in taking to process any benefit claim, and if you are awaiting a Tribunal decision, and could therefore be awarded significant back pay.
Given there is a £6,000 limit on savings or money in the bank, for indeviduals, what happens when the DWP in taking so so long to deal with a claim end up making your balance above the £6,000 limit, or as in recent cases when a DWP misinterpretation has resulted in considerable amount of back pay being paid out?

Its not the clamants fault they they then find themselves over the £6,000 limit?
Do the DWP immediatly start to take the required amount back off any benefit due to being over? As they will know for example if they have paid a claimant say £8,000 or more, they they are of course going to then be over.

As I feel that this almost amounts to a benefit Tax, and a loss of monies, taken from peoples benefits before they have a chance to spend it.

Any back payment should be disregarded for 52 weeks as standard, if it was the result of an Error of Law as opposed to a difference of opinion between the DWP and the Tribunal as to the points that should be awarded then any payment in excess of £5000 will be disregarded indefinitely.
