PIP appeal coming up - can DWP use old assessment?

I was turned down for a PIP claim after a phone assessment in March 2022. I abandonned the claim thinking I might be able to manage without it. I couldn't, and claimed again in January 2023. I scored no points, and after a MR, and 15 months down the line, I have an appeal hearing in a couple of weeks.

I realised, having been ignoring the whole thing until now to preserve my peace of mind (I know, head in sand), that most of the DWPs evidence was from one specialist's medical report that I provided to them. This was from the old 2022 claim which I didn't pursue.

I have Parkinson's which is rapidly progressing, and the assessment from 2022 is now mostly irrelevant.

Are the DWP allowed to reuse an old assessment from a claim that I didn't pursue?

Hi Henry

Have you received your bundle of papers from the Tribunal Service yet? It should be clear what information the DWP used to make their decisions. If you didn't submit an updated medical report in January 23 - then they may well have used the old report they had on record. If you did submit updated information in January 23 and that is clear on your form - they should take note of that.

I'm sorry your condition is deteriorating—but if some of that deterioration has taken place between your last assessment and now, the Tribunal won't take any notice. As difficult and challenging as it is for you, they are there to judge whether the DWP made the correct decision at the time of your assessment in 2023.
