Hi again,my representative had phoned the courts to adjourn the appeal as i didnt have copies of the bundle,they had sent bundles out to the representative as they are representing me,so now my appeal is adjourned reason being i did not also get copies on the adjourn notice i received stated on it saying within 7 days hmcts must send copies to appellent (me)if i dont get bundle by tuesday next week which will be 8 days will the courts just decide on the submission report and anything else that my representative had sent for the appeal,in the submission it includes the points i had got for the first pip appeal living 10 and mobility 12 which only to certain date as i already done a new claim as i since had another health issue plus the other health issues i still have which i scored points on.

Hi Charliem,
I think I'm understanding what you've wrote correctly - You are wanting to know if you missed the deadline, will everything go ahead without your additional evidence ? I believe so. Claimants usually get 1 month to submit their evidence, however if the DWP miss getting there's in on time, the courts usually award them a bit longer - this happened to me, and the DWP were sent a letter telling them that they were over the deadline, but it was extended for them to reply.
Hope this information is what you're after.

Hi chris,its hmcts that has missed the deadline as it states on the adjourn notice.dated 4th september Hmcts must send copies of the bundle to me within 7 days which i assume would of been upto yesturday monday 11th september so because i still have not received the bundle would that mean the tribunal would go by the submission my representative sent to the courts and any other evidence they have or would i need to still wait for bundle and go tribunal when they have another date.
