Background
I was awarded dla high rate and low care for life before being transferred to pip.I was awarded 0 points for mobility and 0 points for care. same with the mandatory reconsideration. After 8 months (28.1.2017)the court of tribunal awarded me high rate mobility and standard care. For 8 months i was practically been housebound.

New assessment 27/7/23
Having just received the letter of their decision basically stating that i still get standard care but no mobility compontent. I am devastated /overwhelmed and finding it difficult to cope/think straight.
I have been/being treated for mental health disorders since 2018 but then treatment stops and i have to refer myself back to the doctor for another referral. My mother died in 20221 so have had to deal with probate and a lot of things have had to be dealth with. this is still ongoing. My head feels like its going to explode.

I have so much documentation to wade through and can only manage chunks of it before i get overloaded. I have tried to get professional help but like most people in their eyes I don't qualify.
I use a walking stick and a mobility scooter... I don't go out much and have been longterm disabled my wife does the shopping and cooking. I could really use some help with this as mentally I dont feel i can go through this again. So I am reaching out to you all for some help to get me throught this

I'm sorry you find yourself in this position. if you need help with your PIP application, you can see if you can find a welfare advisor in your area. I'm not saying it will be easy because most services are stretched to the limit. advicelocal.uk/

I don't know when you got your decision letter, but you have one month from the date on the letter to challenge it through the Mandatory Reconsideration process. If you haven't already, you need to ring the DWP and ask for a copy of your assessment report. This is called a PA4. You need to understand why they have stopped your mobility. They may have written in the letter that you're currently not under the care of mental health services, or there may be something else written in the report. You want to know what you're fighting against. If you haven't got much time left to submit your MR before you receive the PA4 - you get it in, but say that you have not yet got the report, and you may want to submit further evidence when you understand more about their decision.

Mental health treatment is always time-limited, and it doesn't necessarily mean that people have got better when they are discharged; it just means mental health services have to spread out their resources to as many people as possible. You should make this point in your letter if it is appropriate. If you have a mental health disorder, you potentially should be able to score points on the mobility question. I also assume that if you have a mobility scooter, you have a physical disability that also has an impact on your mobility. If your mobility points have been taken away, they are supposed to justify why they think your health has improved and that you no longer require the points. I would look at what they say in the report and what the tribunal said when they awarded you high rate mobility. I know it is some time ago, but unless you have seen a sudden improvement in your health, that judgement will be relevant.

I know you're feeling overwhelmed by this and all the other things you have got to struggle with, so it is up to you what you want to do. You can put in for a late Mandatory Reconsideration if you don't feel like doing it now. You would have up to 13 months from the date on the letter. You have to give a reason for the late submission, but you have your mother's death and your own mental and physical difficulties to cope with.

If you do feel you can tackle this and hopefully, your wife can help you - then have a look at the Guide to PIP Appeals (which includes the MR). Many thanks for your kind words and advice and for taking the time to respond to my post. I tried to phone the cab for advice but after an hour on hold i decided to visit out local offices, where they wanted to try and sort it out there and then, but i was not prepared for that . Long short of it i have an appointment on tuesday. I will be taking the court papers with me

Good for you for pushing forward. Glad that you have been able to find some help from the CAB. Hope your meeting goes well next Tuesday. We are closing down for two weeks - but will be back on the 21st August if you find you have any questions then.
