Hi
I have received a decision notice today from the first tier tribunal, unfortunately my appeal has been refused as I only scored 6 points which is insufficient to meet the threshold. The tribunal accepts that I have the medical conditions specified in the case papers and have awarded 6 points for daily living and 0 points for mobility because I can drive a manual car. Can you please let me know if it’s worth requesting a statement of reasons from the judge to appeal the decision.

Hi Joan
Only you can answer that question.
You have nothing to loose if you ask for a written statement of reason (WSOR) and a copy of the record of proceedings.
To go to the upper tier tribunal you need to find an error in law in the WSOR.
When you apply for a WSOR it may take a few months before you receive it, if you need help then contact either your local Welfare Rights Organisation or Law Centre: advicelocal.uk or lawcentres.org

Hi Gary,
Thank you for letting me know. It states in the decision letter that I only have 1 month to appeal, is this after receiving the written statement of reason. I will request the WSOR straight away, and also a copy of the record of proceedings.

If you do not apply for a SoR then you have one month from the date of the Decision Letter from the Tribunal.
If you do apply for a SoR then it will be one month from the date of the letter accompanying the SoR.
