applying for UC was created by Olive
Hi,
I am in the support group for CB ESA ~ receiving NI credits only ~
1) could I apply for UC with savings of about £14,000?
2) would the support group component be automatically transfered over as LWCRA?
3) would I be paid the LWCRA component of £390.06?
4) or do you only get the £390.06 component if you have less than £6000 in savings?
thanks

If you are only receiving a so-called "Credits Only" claim then I am afraid you are not in the Support Group, Whatever stopped payment of your ESA also closed the claim, you do retain Limited Capability for Work status and it is this that allows payment of your NI Credits which is done under National Insurance legislation and not under any ESA ones.
1. Yes, you can apply for UC with savings of £14,000 but there will be a monthly deduction of a tariff amount for the money in excess of £6000.
2. I would expect you to have to be assessed, you will need to provide a Fit Note for this process to start.
3. You will receive the standard UC personal allowance, if your assessment is successful and you are placed in the LCWRA group then you will receive that rate and back payment from the beginning of month 4 following your providing the Fit Note.
4. No, your savings do not affect the rate you are entitled to, just the money you might receive (see (1) above).

Hi Gordon,
Thank you for your reply.
Can I just check about the LWCRA component:
I thought that I had read somewhere on another website that if you had had an ESA50 assessment and given LCWRA:-
if you later applied for UC, then the LCWRA element would automatically be transferred over to UC and so you wouldn't have to have another assessment?
Is that not correct?
Thanks

ESA claimants in the Support Group who are transferred to UC will have their existing award transferred to an LCWRA one.
Your problem is that you are not receiving ESA and therefore the ESA to UC transfer legislation does not apply to you.
