submitting evidence with review form was created by Csm
When sending back the PIP review form, do we need to include all the medical evidence ( 13 years worth!) which they had on several occasions.
Nothing has changed as the condition is degenerative but on 5 separate occasions the awards prior to a tribunal intervention has been negative.
Just to make sure, does the tribunal consider just the initial review form of information submitted for the tribunal hearing?
Ive noticed this form has been updated on the mobility questions so will study it very carefully.
Thanks in advance for any help on this issue

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Csm
No, you don't have to send in the medical evidence that you have sent before because it will already be on the system. However, be aware that an assessor may not read the system before you have an assessment - so make it clear on your form any past evidence you are referring to. Some people choose to send the same evidence again.
A Tribunal will look at the papers that the DWP and the claimant submit. They look at the most recent review and Mandatory Reconsideration and additional evidence to consider whether the decision was fair or not.

Thanks, given how important these reviews are and the fact that the assessor may not even look at the already sent evidence and just assess on recent activity is worrying. as we have been to 5 tribunals to get her PIP reinstated after each review .My wife's condition is degenerative which is the consultants conclusion backed by medical evidence.
So our question is , as we have no new evidence should we send just the relevant sheets pointing out this and doctors letters and hope they actually look at her whole file or just send the whole lot again ?
We are looking at your excellent help files before we commit to filling out the form and hope this time common sense prevails.

Hi Csm
I can't tell you what to do here because it's a personal choice. As I said in my previous post, you do not need to send in previous information because they already have it. On page 130 of the Guide to PIP Claims and Reviews, it says:
"DWP guidance says the case manager will compare the new information against the evidence from the previous assessment”.
This case manager is a non-medical professional.
So I'm telling you what the DWP says, but I know some people choose to ignore this advice and send in some or all of their evidence again.
If I was doing it, I would answer each question with an update, showing that your wife's difficulties are ongoing from the last assessment (and are either unchanged or have grown worse), and this is in line with information from Dr X, letter dated ...that her condition is degenerative. (use a quote). I would probably send in a copy of any letter that I was quoting from.
You have to do what feels right for you.
