hi mods , after sending in my review form back in october 2020 i then had a telephone assessment in january 2021 , i telephoned and wrote to request my assessment report but after 10 days i phoned again and after missing a call of the dwp 2 days ago i have today received the report and it recommends high rate daily living and standard rate mobility. i was previously on standard daily living only. so i am over the moon as long as the decision maker agrees with the assessor , can you advise me of when the new rates would start from is it the date i sent review form or date of assessment or date of decision letter when i eventually receive it.. it was hard work but your advice and help was invaluable many thanks , bb

Seriously BIS? I thought I'd heard somewhere that the date you sign your form - assuming that an assessment then agrees that you have those increased needs - is the date your award is increased in real terms. So for example, if I signed and dated my form Aug 25th and my assessment was November 29th and the decision was favourable and the actual decision letter was then sent out in January or whenever, they would have to backpay the increased rate from 25th Aug. Otherwise, they could conceivably keep claimants waiting for months and months before assessing them, then keep them waiting again for a decision letter until they get round to bothering to send one and yet all that time your medical evidence and claim form are basically useless in financial terms?! Here was me thinking, well they assessed me early Jan and the report says increase but I still haven't had a decision letter mid-Feb but it's ok because when they do finally get around to notifying me officially I'll get my new rates backdated to the date on my claim form. Am I deluded? Blimey I was banking on that little windfall..!

Hi pollenpath

If it was a new claim then you would be correct but for a review whilst you are waiting for a decision either way, you will still receive your payment.

Once a decision is made your benefit will either stop, stay the same or increase. If you have an adverse decision you will not be hit with an overpayment as your benefit entitlement will stop or reduce from the date of the decision and not the date you sent in the form. Some benefits run on for a few weeks when there is an adverse decision such as Carers Allowance.

thank you catherine, i just hope the decision maker will agree with the assessors report and not take any points off the report , has this happened before ? still waiting for decision letter. many thanks bb.
