DLA to PIP Tribunal Success! was created by Jonpaul
Hi Everyone,
I first started to consult this forum in August last year when our son was unsuccessful in his transfer from DLA to PIP at first he was awarded just 2 points in total. His DLA was high care and low mobility. We asked for a Mandatory Reconsideration and it leapt up to the dizzy heights of 7 points!
After our tribunal this week I am delighted to tell you that he has now been awarded an enhanced award of both mobility and daily living. A total of 34 points!
As they stated an earliest date award we would like to know if that is the date to backdate his payment? it states this on section 1 of the appeal
I would also like to make this a statement of thanks to all at Benefits and Work; without your help it would have been a mountain to climb.
" We highly recommend Benefits and Work; without their assistance and guidance we could not have achieved an increase from 2 points PIP award to a 34 point award! This is by far the best resource of its kind on the Internet!"

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Congratulations on the award.
As your son was receiving DLA the PIP award should apply from the day after his DLA stopped and you should receive back payments from this date.
It usually takes the DWP 5-8 weeks to process a Tribunal result, I would give them a call at the end of the week to double check that they have the Decision Notice, it's amazing how often they lose them.

Thank you! I strongly urge anyone who has been unsuccessful in their claim to provide as much evidence as you can, with medical and social health etc. when you have the opportunity to ask for a Mandatory Reconsideration (MR).
Do this as though your are applying for a tribunal hearing; because if you this at this stage and the MR still says no, all of the hard work has already been done.
In our case our original claim gave 2 points in total, then the MR decision rose to 7 points. We applied for a hearing and used all of the evidence (with a little bit of "tweaking") for the hearing.
The Tribunal gave us 34 points based upon the evidence collated at the time at when we asked for an MR.
If successful take a look at when they have made the award as if you have a claim upgraded, the difference between low mobility and enhanced mobility etc. must also be take into account when the back pay is calculated.
This forum and website is by far the best resource available, there are loads of information to help you.
