Hi sl,

If it is your partner that receives CA for providing care for you, it would be classed as his "Taxable Income" not yours.

Yes, as you will have read in our : ESA Premiums FAQ :

"Severe Disability Premium :

You or your partner must satisfy all of the following:

be receiving the Care component of Disability Living Allowance (middle or higher rate) or Personal Independance Payments Daily Living (either rate)

live alone (there are exceptions to this rule)

no one else must be getting carer's allowance for looking after you"


If you don't live alone, and/or someone else is receiving CA for providing care for you, you would not be entitled to The SDP.

Remember, to be entitled to any ESA Premiums, you must be able to pass the means test for entitlement to Income Related (IR) ESA.

Your partners CA and any income that they may have would be classed as household income in the IR ESA means test.

The Occupational Pension (OP) that you receive would also be classed as income £for£ in the means test.

If you haven't already done so, you should inform the DWP regarding the OP that you receive.

As advised, it would be classed as household income for IR ESA means test. Further, there is a rule with CB ESA as well, where any OP received in excess of £85/Week will result in deductions from your CB ESA.

e.g. OP = £105/Week = £20 in excess. 50% of this excess, i.e. £10 would be deducted from your weekly CB ESA.

Even if the OP does not exceed the £85/Week allowed, you should still inform the DWP in writing if they are currently not aware of it.

Regarding your entitlement and payment of any ESA Premiums, to be sure, you may be best requesting an ESA 3 Financial Assessment Form from the DWP.

This is purely to capture your financial/personal details, and has nothing to do with The ESA WCA and which group that you are in.
