Mark Perlic, author of the 600+ page PIP Case Law Pack, is running two free webinars for Benefits and Work members on how to best use case law for PIP claims, mandatory reconsiderations and appeals.
Understanding case law can make a real difference to your chances of success, especially in areas like PIP and mental health where the law may be rapidly changing.
Because DWP decision makers will only quote cases that support their position.
And you can’t count on first-tier tribunal judges to always be abreast of current case law.
So, learning how to find and use case law yourself is a very valuable skill.
Which is why we are delighted that Mark Perlic, author of a number of indispensable legal volumes Used by advice agencies, tribunal judges and representatives across the UK, including:
- The Personal Independence Case Law Pack
- The DLA and AA Case Law Pack
- The Work Capability Assessment Case Law Pack
- The Making Appeals Work Tribunal Practice and Procedure Case Law Pack
is delivering two free webinars for Benefits and Work.
The three hour webinars, each with a break in the middle, will help you learn how to find case law and how to use it to increase your chances of getting the correct decision at mandatory reconsideration and appeal stage.
Although the webinars focus on PIP, the skills learnt can equally be used in connection with other benefits, including DLA, ESA and UC.
The webinars will be recorded and will be available for playback for anyone who registers but is unable to attend or who can’t manage a three hour session.
Topics covered include:
- The role of the first-tier tribunal - evidence, facts and law.
- The law - regulation and case law (establishing the ‘correct legal line’)
- What is case law - reported and unreported decisions (what’s the difference?)
- How to find case law - obligations to provide copies of case law decisions
- How to use / make reference to case law in mandatory reconsiderations / appeal submissions
- First-tier tribunal duty to follow case law and departure from statutory language
Mark Perlic tells us:
“The webinar will provide answers to the following questions::
How should the law and case law impact decision-making?
What is case law and what relevance does it have?
How can you find and use supporting case law in a mandatory reconsideration or appeal submission?
What is the duty of a first-tier tribunal to follow case law principle and what if it does not?
The webinar will underline the value of case law. It will show how the DWP may use case law against you and what steps you can take in this instance. It will help in your understanding between what is the regulatory position and the ‘correct legal line’.
An ignorance of relevant case law can lead to errors in decision-making by the DWP and a first-tier tribunal.
From a claimant or advisers’ point of view it can limit your chances of success or leave you wondering how your case failed or indeed how it won through.
You need to be aware of what case law supports your case and what may undermine it.
And you need to know how you can seek to make your own case law.”
