The DWP acting on behalf of the Secretary of State can seek to assess a claimant at any time. Indeed in the migration plans it states that whilst they seek to follow the IB review date to convert the claim to an ESA on, it will also call outside of those dates where it is helpful to maintaining a sufficient supply of candidates for assessment/conversion

The worst deal seems to be for the exempt claimants and those with no fixed review date. They are to be migrated within 12 months as I recall, and this means some with less than exemptable severity and with a review date of 2013, will likely be left alone whilst the 'exempt' claimant, perhaps with a very very severe condition, will be called perhaps 18 months earlier

Your best case is to apply to the DWP for the rules that the doctors follow in recommending review dates to the DM , see if your review date was medically appropriate. Some people end up called in 2 years where via the rules they should have been 3 or 5 years etc

The pain is only beginning

The governments DWP impact assessment on time limiting ESA suggests that NEXT year 550000 claimants will lose benefit altogether because their parter works or they have savings over the limit. The projected figure for 2015/16 is 700.000

The law is not yet passed, but this is the impact assessment. MILLIONS of people who satisfy the ESA medical criteria will nonetheless lose their benefit due to means testing, chopping off close to £100 a week from hundreds of thousands of families/couples at a time of relentless increases in the cost of living
