I read somewhere that a claimant would be exempt from the WCA if working would cause a 'significant deterioration in their condition' but I can't remember where I read this. I think it may have been in one of the training documents for assessors by Atos but I just can't find it again. Does anyone know if the effects of working are taken into account in this way?
I think you are referring to the ESA 'exceptional circumstances':-
you suffer from some specific disease or bodily or mental disablement and, by reasons of such disease or disablement, there would be a substantial risk to the mental or physical health of any person if you were found not to have limited capability for work.
There's more on this in the claims guide. It doesn't just apply to work but being 'found not to have LCW'. This takes into account anything you would have to do that you don't do at present such as the journey to work or coping with the JSA regime.
