Hi ,
I have looked at many post but cannot find any post that can help me . I am still on long term IB (-well for now)-due for a review on the 9th june 2011 as yet not recieved any letter yet, but i'm sure i soon will !!! .Does any one no if you recive the same amount of benefit on ESA as long term IB , MANY THANKS Tilly :)

The Government is offering Transitional Protection for IB claimants being transferred to ESA.

There are two aspects to this, first your ESA payments will not be less than your current IB ones, if necessary an additional payment will be made until the ESA rate catches up.

Secondly, if you have a pension and it is currently disregarded under IB it will continue to be under ESA.

In both cases the proviso is that the claim is uninterupted.

When you are transfered he will receive Contribution Based ESA. The Government are currently enacting legislation that will limit the receipt of ESA(CB) to one year for members of the WRAG, but not the Support Group.

After the year, claimants are eligible to receive Income Related ESA, however, this is means tested and takes all income and assets into account, this may mean that a claimant would no longer receive payment for their ESA.

Gordon , Thankyou for replying so soon - very good of you . My Husband works full time and brings home an average wks pay , is there a figure of how much you will be means tested on per yr . Regards Tilly

There are two aspects, first your partner must not be working more than 24 hours per week as to the income, I cannot give you an exact figure as it will depend on your circumstances, but anything over £124/week is likely to mean you would receive no benefit.

Sadly many of us on IB will be in that catergory, and it looks as if the legislation is making its way through the parliamentary channels, with little effective amendment.
It is fairly obsurd that after paying into the NI scheme, you are no longer eligable after a year. That is certainly the case with me. And even if and I am hesitant in saying this, they do change their minds and reallow ESA to be claimed continuously on an NI basis, those of us whom have been chucked off the benefit will never ever re qualify for it, due to not having met the NI contributions. We simply will be faceless and invisible. This should never have been allowed to happen and will turn out to be one of the greatest mistakes they will ever make.
