Please can anyone advise me as to whether I am correct in reading that from 2012 if you have previously claimed Income Support or Incapacity Benefit for the last few years, but are then moved over to the ESA Work Related Activity Group your ESA money will be stopped after one year whether you still have medical problems or not?

Please can anyone explain the difference between Income-based ESA and Contribution-based ESA. My NI contributions were as far as I am aware fully up to date before I became ill. Would this mean that I would qualify for Contribution-based ESA?

If you are currently receiving IB or SDA then you will be transfered to Contribution Based ESA.

If you receive Income Support for health reasons, you will be transferred to Income Related ESA.

In either case the transfer will be considered a continuation of your existing claim.

ESA(CB) is a personal claim and takes no account of you savings and income with the exception of any pension income in excess of £85/week unless your pension was excluded under IB. ESA(CB) is liable to tax.

ESA(IR) is claimed by a couple, assuming you have a partner. All income is deductable and assets over £6,000 will affect your emtitlement. There are also limitations on how mamy hours a partner can work.

The Welfare Reform Bill will limit eligibility for ESA(CB) to one year from the Effective Date of Transfer or 6 April 2011, whichever is the later, for members of the WRAG, but not the Support Group.

Thank you for the quick and detailed reply

I have been receiving Income Support for health reasons. I am hoping I will be moved on to Income Related ESA if I am put into the Work related activity group so that my claim will not be time limited.
