You can both make a new claim and appeal the previous one.
With regard to your broken leg, assuming your doctor will write you Fit notes, you should contact the DWP and raise a new claim for ESA because of a new condition.
The latter part is important, as they will will otherwise refuse the claim because it is within six months of a previous refusal.
As to your original claim, have a read of our ESA Appeals document in the Members area, which will explain how to lodge an appeal, what evidence you should collect and how to submit this to the Tribunal Service.
You would be well advised to seek face to face advice with regard to an appeal, as an advisor will be better placed to advise you than we can on these forums.
