I thought I would give you a little update on how my son's DLA Appeal went.
On 8th March, my son's case went before the tribunal panel again. The first time it was adjourned due to vital paperwork going 'missing' from the apeals bundle. There was a representative from DWP present at the second tribunal. The DWP had based their case in refusing my claim soley on the basis of a school report. The headmistress had stated that my son had no 'extra needs' whatsoever in the school report and yet previously - two weeks before she signed the school report sent to her from the DWP, she was present in a meeting and signed a statement verifying completely the opposite. That my son required assistance with toileting and had a mentor each lesson on a 1:1 basis!
To cut a very long story short (and I am renowned for writing long posts!)
The judge then sent me out of the room and called me back within 2 minutes, stating that my appeal would be upheld and all the monies owed since February 22nd 2010 backdated. My son was awarded middle rate care until December 2012.
It's been a long fight and I would like to thank this site for all the advice and helpful comments.
