Listening to stories like yours makes me so angry.

I went to see my MP at the weekend to express my deep concern over welfare reform - subjecting vulnerable people to unfair medicals and stressful appeals etc etc.

My advice to you would be to ask for an urgent reconsideration as part of the appeal's process and would approach Citizens Advice and your GP to support you with this. I would also consider contacting your MP to ask for their help and to make them aware of the true scale of suffering.

I understand that it is difficult to function when you are so overwhelmed with distress and in a lot of pain due to your illness and mobility difficulties.

People on this site will continue to offer their advice and support. Try and be positive - at least you were not awarded 0 points. It is ridiculous to think that you are going through all this anguish and worries about your finances due to a missing 3 points. If you were hoping to make the support group and think you meet the criteria, I would make your GP/CAB aware of this.

Hopefully it will all be resolved sooner rather than later.

If you don't have any money to live on until you receive the assessment rate, consider asking Jobcentereplus for a Crisis Loan to keep you going until payments are received. It's repayable and instalments would be deducted from your ESA payments when you get them.

This should not be an issue to your appeal as you were not assessed using these criteria. The Tribunal must use the same criteria as the Decision Maker did.

We are still expecting the new ESA50 to be released next week and that medicals using the new criteria would therefore begin in late April.

To clarify, for other members reading this, if you have received and filled in the existing ESA50 you will be tested using the existing criteria, not the new ones.

Derek's comment id correct, however I made an ESA claim on 8th Feb.. and still have to receive my ESA50, I reckon they will wait and send me the new form.

Thats reasuring at least, the esa50 i filled in mentioned nothing about, wheel chairs in the walking part.

Im shocked at them stating i can walk 200 meters but at the same time going by other storys im not shocked at all. i can not wait until i see the medical report, i made sure i was adament i could not walk any distance without pain, i rember clearly telling the lady who examined me that i could not bare any weight on my leg without sever pain and this is also what i wrote down on the esa 50. so how they have come up with i can walk 200 meters is totaly beyond me.

From my experiance with dla and now esa, its clear to me that theese tests are indeed not fair and theese people are not trying to make fair judgments they are trying to get people off the benifits with total disregard to weather theese people have a genuine disablity that limts their capability of work, i used to think it was fair just hard to meet the criteria, i truley belive with all my heard the entier system is corupt and its so frustating when people say that it isnt, i feel like i am been framed for a crime i did not comit and there is little i can do about it, its the most frustrating experience i have ever had to deal with. i wish i had sent in my own medical evidence from my gp now. i think gathering out own evidence by the bucket load is the best thing we can do and thats my next move, i used to be very axcious speaking with my gp but im not so angry i can not wait to speak with him and get his support. i WILL win this battle for both esa and dla its just a matter of time its just a shame the huge inconvinecne and stress this is giving me while i do so :(

Regarding getting my money reinstated at assement rate,can i get this done over the phone, or do i need to send the gl24 form with my gps report which i will get, i dont want to ask for an appeal then they reconsider before i get a chance so send a report from my gp.
