I have been receiving Low mobility and medium care for just over 1 year and had to reapply in Novmember. Was turned down in Jan and when i read the letter after 3 times i realised it was turned down because my medication has improved my epilepsy (only if i carry on taking it which i cannot remember without my husband getting it out and watching to make sure i take them - twice a day) and also because they have decided i am safe to leave me alone which sometimes is ok but on my bad days i have to have 24hr care as cannot do anything for myself due to shaking problems (general distonia but not confirmed) some days i am absolutely fine from the shaking but my memory and processing is slow and poor and therefore if i want to go out need support am waiting for reports about my memory and processing problems. In addition they have used the ESA Medical report which meant my ESA was turned down initially but allowed after tribunal (doc at medical said i could control my shaking problems if i wanted) tribunal did not agree with that when they saw me. DLA do not appear to have looked at that report. Is it normal for DLA to us a ESA medical report that is almost 1 years old. My sister has spoken to DLA and said we dont agree and answered loads of questions on the phone and we are waiting for the result from that. This has put my stress shaking worse once again and would like any help on this matter or thoughts from someone who may have been in this situation.
Decision Makers do sometimes take into account ESA medical reports when determining awards for DLA.
If you want to appeal, don't forget that you have a month from the date of the decision (plus another two weeks after you get details fo the decision).
