Hi everybody

I hope I have posted this on the right forum, I have been trying to help my brother-in-law and pointed him to this site as he has been refused dla, I explained about getting evidence for his appeal and told him to ask for his medical records from his doctors as one piece of evidence - but when he asked they said they couldn't do this because there is too much paperwork to photocopy! unless I am mistaken I thought it was a legal right can anyone help please

You are not mistaken, everybody has a legal right to see information held about them with a few exceptions, and I don't think too much paperwork to photocopy is one of them!

With regards to their refusal to provide the documents; he could make a written request for the information under the Data Protection Act (which can take time), or if he was refused by a receptionist, he could ask to speak to the person who manages the surgery.

Alternatively, he could ask to view his files. My surgery allows patients do this but I'm not sure if it's the same with all surgeries.

When you make a request for information it is important to say how many years of history you want, as it may not be necessary to retrieve his entire files since birth and there is likely to be a fee or a charge per sheet. If he gets the opportunity to look at his files and choose what documents he finds useful (as I have done) it's possible the photocopying will not be so great.

Hi c00kered, I was asked to put my request for medical notes in writing, stating exactly what I require.

I think, as Derek has suggested, you do this and copy your letter (which can be sent to MP at a later date if necessary).I doubt very much that they can refuse, or would refuse a written request, especially if you reference the freedom of information act.

I asked for notes and correspondence dating back 13 years (ish) and it cost me about £20 I think, can't remember exactly.

There are maximum fees for getting medical notes.

Printed - £50
Computerised notes - £10
Mixed printed and computerised notes - £50.
