hi can anyone tell me if a person was awarded SDA 4 years ago until their 65th birthday will he be recalled for another medical for esa purposes or will he be protected by the rules/law that existed at that time. He was originally awarded sda in May 1997 and had regular medicals however at his last one in 2006 the doctor decided his condition would never change only get worse so awarded sda until 2025.
He also was awarded DLA in May 1997 (high rate mobility, middle rate care) which was made indefinite in 2004 for both.

There would appear to be no exemptions for claimants of SDA, and the application of the work capability assessment for ESA purposes.

If the person does not reach the age of 65 until 2025, he will be migrated onto ESA at some point between March 2011 and March 2014.
