We recently moved house and my husband signs regularly for JSA in new area, all of a sudden without any warning a letter arrives to say that our joint claim for JSA needs me to sign for JSA in order to get any payment. Even the people working in the new jobcentre say that it is not a joint claim.
I get DLA only of HRM/LRC and was early ill health retired a year ago because of osteoarthritis in much of my joints and fibromyalgia.
My husband has spent a fortune ringing about a problem that i cannot see resolved and in the meantime, we have bills and debts piling up that we cannot pay.
They have just decided to give my husband the disability premium that he receives for me and that is all. They also want to know what is wrong with me and to provide medical reports to the jobcentre as he has told them that i am too ill to go down there.
Can they do this, i thought that DLA was not a means tested benefit and my medical history lies with my new doctor, i think?
Please help, wish we had never moved, had none of this before.

Adviceguide has something on this point. They say "If you are one of a couple who live together (and you do not have a dependent child) both you and your partner usually have to meet the job seeking conditions to get income-based Jobseeker’s Allowance. This means you will both have to sign on and look for work."

I know it's slightly off-topic, but turning this around, does this mean that the person receiving DLA whould also receive JSA or ESA, dependant on the their capabilities or is this covered by a joint claim? B)

Where two people live together as a couple, they claim JSA as a couple, not separately. Normally, where a couple claim JSA, both must sign on, but there are exceptions, including where one partner is entitled to IB or ESA. It is not possible to claim ESA if you and your partner are entitled to claim JSA as a couple.

An adviser can look at an individual's circumstances and see what they specifically are entitled to - we can only give general information and advice here.

Many thanks Survivor for your advice but surely one has to be actively seeking work in order to claim JSA? In my case as well as many others like me at 57 with the type of disabilities i have, i would love to have stayed in my old job caring for terminally ill patients, but nowadays can barely walk across to the other side of the bedroom without losing balance through weakness and pain. I really fear what lies ahead, not a good prospect for someone coming close to the retirement bracket.
