I am about to be retired from the public sector having been injured at work two years ago. I was awared a 40% injury award as an addition to my pension. I have just received notive that my employer will reduce the injury award by the amount of non means tested benefits I receive. This is a new move by my employer and I was wondering if anyone in similar circumstances has received this type of notice or even if such action is legal given that the benefits in question are not means tested. Thank you
I think this is an employment law isue rather than a benefits issue. But I do know it is not uncommon for employment tribunal awards to take into account benefits that the appelant has received when deciding on the amount of compensation to be awarded.
