Hi Catherine,

There are two guides to DLA appeals in the members area, plus one on challenging medical reports and another on caselaw. They should provide you with all the information you need.

And bear in mind that lots of people don't provide any written submissions and still win. It all depends on the case and what evidence needs challenging or reinforcing.

Good luck,

Steve

Terrific news Loose Cannon. Well done. I agree with you completely - stand up for your rights.

For Kathy - my DLA Appeal last week was opened by the Panel introducing themselves. Then my Advisor from the CAB made a statement to them explaining why I was making the Appeal. He'd already written a statement to the same effect including a brief statement about the errors in the ATOS ESA medical they'd used instead of contacting my current GP or having a new medical done. I had written a full length report itemising every single contradiction and inaccuracies in the ATOS doctors report already. My CAB advisor also pointed out that ESA and DLA were two completely different Benefits and the criteria for successful claims were entirely different. The Panel must have thought so too, as after 10-15 minutes of asking me questions - mainly by the Panel Doctor (who even then was just really checking I'd got the symptoms and medications consistent with the illness)- they adjourned and then called me back telling me I'd been awarded Higher Rate Mobility. Hope this helps. Jenny
