WCA and substantial risk was created by DJMH15
If you ar e an a legacy recipient of esa will the substantial risk element continue to apply?
Are they removing it for everyone?

I have been wrongly taken from legacy and put into new esa, I think treated now as a new claim!

It formed a really important part of my claim since when I’ll I do life threatening things.
It’s hopeless…enacting it once someone is at so ill they are at risk or putting others at risk is madness. The damage is done. The clause helps to prevent illness deteriorating to this level by giving us enough to live on so we don’t have to stress so much and become ill.

Please is this question able to be answered
