Hi

My Father has sadly passed away & in his will he is leaving me half of his house ,the other half to my brother .
My brother wants to live in the house & buy my share .
We will be going the solicitors & probate soon has its a bit complex his will, i should imagine it will take 6 to 9 months for probate to complete ,then process of brother paying for my share of house .

Going forward with things how will this affect my benefits ?
I am on Esa Contributory based support group with a top up of income related esa .
I get Housing Benefit .
I get Pip high & standard rate .
Will i lose all my benefits or would i still get Esa Contributory based & Pip,
Am i right in thinking the income related Esa & Housing benefit will stop
has over the limit ?

Hi vic,

You will continue to be eligible to means tested Benefits as far as capital is concerned until the executor has distributed the estate. You will lose entitlement when you own assets, capital or investments over the £16000 threshold. However there is an exception if your brother were to be disabled and living in your property.
If you have capital over £16000 though your PIP and ESA C will remain in payment unaffected.

Thanks for your quick response David much appreciated.
No my brother is in good health & working .
it will be a case of letting the dwp know once monies distributed & like you said get Esa contribution based & pip until my retirement in a few years time .
