Strange housing situation was created by Sam
Hello all I have a strange situation and I'm wondering how I explain it as I’ve just got the dreaded migration notice. I own the house I live in and share with my friend (also she’s my cousin) this house was given to me by my parents about 8 years ago. My friend and I both pay a small amount ( me £25 and her £250) a month into an account my mum owns so she can take care of house insurance and various repairs, this was something that happened even before I was given the house. At no point have I ever claimed housing benefit nor have I had access to the back account we pay into. My question is are the DWP going to see an issue with this? Also does cousin count as living with a relative for dwp ?

Hi Sam,
You say you were given the house so I assume your name is on the deeds/Land Registry records as owner. Therefore you cannot claim Housing Benefit or UC Housing Costs. However you can still claim Universal Credit if you have a low income.
What Benefits are you and your cousin thinking of claiming? What ages are you ( you may be pensioners) ?

Yes I'm the deed owner and have no plans to claim housing benefit, I'm currently support group ESA moving to UC. My cousin isn't claiming anything and I have nothing to do with her finances. We are both 40.
I just really want to know if the DWP are going to want to know why my cousin isn't paying me rent.

Hi Sam,
The payment of rent by one party to another falls under the remit of Landlord and Tenant law. This has nothing to do with the DWP. So why should the DWP be asking about it ? It would be a different matter though if you did have an income from another source which you did not declare.

Thankyou, I did think it would be strange for them to ask but I do tend to over think things. This site helped me a great deal many years ago when I was assessed for the support group and I'm very grateful you are all still around to help with this
