PIP review after tribunal decision was created by Claire
Hi there

Can you help? I have been given the PIP review forms by the DWP. My last PIP assessment i scored 2 points but at tribunal i won my case with standard daily living and enhanced mobility. The review forms say 'has your conditions changed'. "How" my disability affects me hasn't changed however my understanding of the disabilities and extra diagnosis to explain my difficulties have. Secondly, between my 1st assessment in which i scored 2 points and the tribunal, my condition HAD deteriorated. So what do I put in the box. If i say yes my condition has changed then i'm frightened my payments will stop automatically while its being reviewed and i will likely lose my motability car which i have just received and i cannot do without. I don't want to put "No change" because they only awarded me 2 points last time and had to go to tribunal. How should I answer the question?

Hi Claire,
Firstly, and this important, assuming that your award is still current,(ie not reached the end date imposed by the tribunal,) then DWP can not legally change the award.
What I suggest is that you write your disabilities as per the evidence you gave to the tribunal. However, if something has become sufficiently worse to give rise to a higher points value then describe the deterioration.
So...maybe something like this...
Tick no change then add DWP previously awarded 2 points for Descriptor 1. I explained in the initial review form/claim form that due to eg poor eyesight I needed supervision to prepare and chop vegetables etc etc...This was evidenced by a letter from my social worker.
The Tribunal agreed and awarded 4 pts on X date.
Send in a copy of the Tribunal decision letter and a repeat of the evidence, with the review form.
If you now have a formal diagnosis eg if what was eg just 'leg pain' but now relates to a certain condition say so, if eg the GP has explained about pacing yourself, ir not doing certain activities because its dangerous or might aggravate your health say so too.
Good luck.
I hope this helps.
