hi i have a query. my husband has been recieving contribution based esa with an income related top up for years (continuous support group after 20 years working until the day he collapsed). The only other help we get is my carers and his pip as we have no kids or housing costs. From what i can tell the only part of our money being forced to migrate is the small income related esa top up which appears to be about 50 pound a week. (which will degrade with time over transitional protection anyway) ...in theory if we ignored our migration notice what would happen? ..we would still get pip and carers, correct? But would my husband still get his contribution based esa, even though its the old one been running for years and not "new style esa" ...thanks

Hi RachIv,

Yes, your husband would still receive his Contributions Based ESA.
As you would be ignoring UC migration his Conts Based ESA would not be converted to New Style ESA.
Carer's Allowance and PIP remain unaffected by UC migration.
All means tested Legacy Benefits such as Income Based ESA would stop.

thank you for the quick reply. I wasnt sure if his contribution esa would continue without some sort of intervention. If everything else stays the same then we will have to decide if 50 pounds a week less and having to pay for his prescriptions is worth not having to face migration.

Hi RachIv,

I would keep watching this forum and other member's experiences re Migration before making a decision. £50 a week is quite a lot of money and also losing NHS concessions.
Remember Citizens Advice Help to Claim will do all the difficult work for you and their phone no is usually in the Migration letter.
