Savings query UC migration was created by Star jacks
Hello, can anybody help with some advice -
I am on IR ESA in Support group but not had migration letter yet but i am worried when i do how my capital will affect it.
A few years ago i received a big ESA backpayment due to their error of £16,500 which ive kept in an ISA. Since then ESA have always disgregarded this as savings when ive had my reviews. I am concerned this wont be the case when i migrate and then i will be over the £16,000 savings limit.
Does anyone know about backpayments re migration to UC or been in the same situation. Thank you.

Hi Star jacks,

Yes, the capital in your situation will carry on being disregarded indefinitely if your UC claim is commenced through Managed Migration. You will find the relevant legislation at paragraph 11 of Schedule 8 of the ESA Regs 2008.

However that would not be the case if you closed your claim yourself and then re-claimed at a later date.

Thank you for your reply David thats reassuring.
So how would i state on the UC form that it is a backpayment as it is online? If i just type in i have more than £16,000 savings will it say i cannot migrate or if i type in the amount i have in my ISA without a reason it will still look like i have too much savings? Am just worried they will close it down before ive even started without explaining then will loose my ESA too, if that makes sense.

Hi Star jacks,

I don't think that at this stage there is anything to worry about.

There aren't any forms for your to fill out. Universal Credit is designed to be " Digital by Default ".
All your Benefits payments are held on a DWP IT system called CIS Searchlight including your backpayment.

When you get your Migration letter you will be given the UC Migration helpline. So if you are worried you can phone them.
The DWP have asked Citizens Advice to assist them in the UC Migration process with a scheme called Help to Claim and you will be given details of this with your Migration letter.
