Hi many thanks to the authors and contributors of this site for all the help and advice given to me which culminated in overturning the disgusting decisions by ATOS and the Dhss. I was awarded enhanced rates on both daily living and mobility for 3 years from 06/ 2013 to 06/ 2016 anyone know the length of time it takes for the dhss to make payment on an award for backdated pip from tribunal appeal , have been waiting for over 5 weeks for a response of some sort from the Dhss , is this the norm, or am I being impatient after applying for pip 23 months ago 6/2013 . How will I know if if I will be paid the correct amount of backdated benefit because the benefits rates changes all the time and I can't keep up with it. Many thanks again to everyone who took time out to help me .

It can take 6 to 8 weeks for the DWP to take action regarding a successful appeal decision.

You might want to phone The PIP Helpline for an update :

Telephone: 0345 850 3322

Textphone: 0345 601 6677

Monday to Friday, 8am to 6pm

You could also post a copy of the Tribunal Decision Notice letter that you have to PIP DWP, with a covering letter :

Sending Documents to the DWP.

There have only been small increases in PIP payments since June 2013, on 07/04/14, and 06/04/15.

You can check the weekly rates for PIP from 2013/14, 2014/15 and the current rates 2015/16 on the FAQ below.

Benefit Rates 2015/16

This will give you a good idea of how much back pay to expect.

Roughly you have from June 2013 to 07/04/14 Care component: Enhanced @ £79.15/Week.

From 07/04/14 to 06/04/15 Care component: Enhanced @ £81.30/Week.

&

From 06/04/15 to date Care component: Enhanced @ £82.30/Week.

For Mobility :

From June 2013 to 07/04/14 Mobility component: Enhanced @ £55.25/Week.

From 07/04/14 to 06/04/15 Mobility component: Enhanced @ £56.75/Week.

&

From 06/04/15 to date Mobility component: Enhanced @ £57.45/Week.

As a very rough guide, you could be looking at over £14,000 in arrears owed.

Large sums of back payment such as this are dealt with by a special DWP team as they have to undergo scrutiny.

Such back payments will be paid straight into your Bank Account separately to your normal 4 weekly PIP payments once they start, and may be paid in before you receive a letter with a breakdown of the amount of arrears paid.

I don't wish to put a dampener on your success, but The DWP can appeal The Tribunal Decision if they think that The Tribunal have erred in law in coming to their decision.

The first step in them contemplating this would be for them to request a written Statement of Reasons (S of R) from The Tribunal.

You would know, as you would also receive a copy of The S of R through the post.

The DWP have one month from the date of The Tribunal Decision Notice to request an S of R.

You could also contact The Clerk to The Tribunal to see whether The DWP have requested an S of R.

N.B. Under no circumstances should you request a written Statement of Reasons from The Tribunal yourself.

Hopefully, they have not, and will simply pay you what you are entitled to ! :)

I think the wait may be normal for them. I had my tribunal on 8/3/15 and received a letter today asking if I had been in prison in the last 2 years or been abroad for more than a month since making my application - also 2013.Hopefully a step in the right direction. Fingers crossed for both of us.
I have phoned them regularly since april but it's made no difference!!

That's great news Danny! Thanks for letting us know and for your kind words about B+W :) I hope that you don't have to wait much longer for your backdated money - and that you are able to buy yourself something nice with at least part of it.
