yippeeeee wife/blind won appeal was created by sonjay
Last october i posted on here that my wife who is blind, has heart disease and has depression and anxiety attacks was placed in the wrag group.
We appealed the decision for her to be placed in the support group and yesterday we went to tribunal and i am pleased to say she won the appeal. It was won on the grounds of cannot cope with change due to cognitive impairment or mental disorder, to the extent that day to day life cannot be managed.
I would like to thank everyone on here and b&w for the encouragement and information to be alble to go to appeal.so thankyou thankyou, its so nice to see a smile on her face if only until she gets the next esa50. she had a representative for her who was fantastic. so to anyone else i hope this gives you encouragement to fight and best of luck to you.

First, a point of admin, it would really help if you could in future create a new thread rather than tagging your post on to another one, that has nothing to do with the subject of your question
With regard your question.
First, it will depend on whether you are receiving Income Based or Contribution Based ESA?
Do you receive DLA?
Is the course full time, part time, or distance learning?
Are the requirements of the course consistent with the statements you made whan completing the ESA50?
Starting education may be classed as a Change of Circumstances, requiring you to notify the DWP!
Unfortunately, as you can see this may not be a simple decision, you really need to sit down with a suitable advisor who can sit down with you and go through your options.
Where to get advice?
